MORTGAGEE’S SALE OF REAL ESTATE

By virtue and in execution of the power of sale contained in a certain mortgage given by Joseph M. Condon and Brenda L. Condon to Metro Credit Union, dated January 18, 2008, recorded or filed at Middlesex County (Southern District) Registry of Deeds in Book 50610, Page 438, of which mortgage the undersigned is present holder, for breach of the conditions of said mortgage and for the purpose of foreclosing the same, will be sold at public auction at 10:00 a.m. on the 11th day of May, 2018 upon the mortgaged premises located at 224 Springvale Avenue, Everett, MA 02149, all and singular the premises described in said mortgage, to wit:

The land in Everett, Middlesex County, Massachusetts, with the buildings thereon, the buildings numbered 224 Springvale Avenue, and the land being Lot 167 and part of lot 166 on plan of Washington Park, Charles A. Pearson, Surveyor, dated April 1892, recorded with Middlesex South District Registry of Deeds in Book of Plans 74, Plan 12, bounded and described as follows:

NORTHEASTERLY: by Springvale Avenue, forty (40) feet;

NORTHWESTERLY: by Lot 168 on said plan, one hundred (100) feet;

SOUTHWESTERLY: by Lots 179 and 180 on said plan, forty (40) feet;

SOUTHEASTERLY: by the remaining portion of said Lot 166, one hundred (100) feet.

Containing 4000 square feet of land, more or less and according to said plan.

For our title see deed of Diane M. Rutstein recorded with the Middlesex South District Registry of Deeds, herewith.

In the event of any typographical errors in the publication of this notice, the description in the said mortgage shall control.

The above-described premises shall be sold subject to all easements restrictions, municipal or other public taxes, assessments, liens or claims in the nature of liens, outstanding tax titles, condominium fees, building, zoning and other land use laws and all permits and approvals issued pursuant thereto, including, without limitations, orders of conditions, and existing encumbrances of record created prior to said Mortgage, if there be any. Said premises are to be sold subject to the right of redemption of the United States of America, if any there be.

Five Thousand and 00/100 ($5,000.00) Dollars of the purchase price must be paid in cash, certified check or treasurer’s or cashier’s check at the time and place of the sale by the purchaser. The balance of the purchase price shall be paid in cash, certified check or treasurer’s check or cashier’s check or other check satisfactory to Mortgagee’s attorney within thirty (30) days after the date of sale (or the first business day following thereafter if such date falls on a Saturday, Sunday or a legal holiday) at the offices of Phillips & Angley, P.C., One Washington Mall, Boston, Massachusetts 02109. The successful bidder will be required to execute a Memorandum of Sale immediately after the close of bidding.

The deposit paid at the time of the sale shall be forfeited if the purchaser does not comply strictly with the terms set forth in this Notice of Sale or the terms of the Memorandum of Sale executed at the time of foreclosure.

The Mortgagee reserves the right to bid at the sale, to reject any and all bids, to postpone the sale to a later date by public proclamation at the time and date appointed for the sale and to further postpone at any adjourned sale date, to sell the property to the next highest bidder in the event of default by the highest or any other bidder, and to amend the terms of the sale by written or oral announcement made before or during the sale. If the sale is set aside for any reason, the Purchaser at the sale shall be entitled only to a return of the deposit paid. The Purchaser shall have no further recourse against the Mortgagor, the Mortgagee, or the Mortgagee’s attorney.

The purchaser shall be responsible for all closing costs, state documentary stamps and recording fees.

By virtue of and in execution of the Power of Sale contained in a certain mortgage given by Roseline Bazelais and Jean Bazelais to Mortgage Electronic Registration Systems, Inc. acting solely as a nominee for SouthStar Funding, LLC, dated December 2, 2005 and recorded in Middlesex County (Southern District) Registry of Deeds in Book 46597, Page 405 (the “Mortgage”), , as affected by a Loan Modification Agreement made December 1, 2008 and recorded at said Registry of Deeds in Book 52922, Page 145, and as further affected by a Loan Modification Agreement dated April 1, 2012 and recorded at said Registry of Deeds in Book 59499, Page 102 of which mortgage U.S. Bank National Association as Trustee for RASC 2006KS2 is the present holder by assignment from Mortgage Electronic Registration Systems, Inc. to U.S. Bank National Association as Trustee dated September 22, 2006 recorded in Middlesex County (Southern District) Registry of Deeds in Book 51379, Page 481 and assignment from U.S. Bank National Association as Trustee to U.S. Bank National Association as Trustee for RASC 2006KS2 dated January 18, 2011 recorded in Middlesex County (Southern District) Registry of Deeds in Book 56429, Page 394, for breach of conditions of said mortgage and for the purpose of foreclosing the same, the mortgaged premises located at 33 Everett Street, Everett, MA 02149 will be sold at a Public Auction at 3:00 PM on May 9, 2018, at the mortgaged premises, more particularly described below, all and singular the premises described in said mortgage, to wit:
